It’s Food Safety Education Month—A Good Time to Highlight Third-Party Certification

September is National Food Safety Month in the U.S. The U.S. Food & Drug Administration (FDA) regulates dietary supplements differently than either conventional foods or drug products.According to the Dietary Supplement Health Education Act of 1994 (DSHEA),manufacturers and distributors of supplement products are prohibited from marketing products that are adulterated or misbranded. “That means,” the FDA says on its website, “that these firms are responsible for evaluating the safety and labeling of their products before marketing to ensure that they meet all the requirements of DSHEA and FDA regulations.”

That’s one reason certification of supplement products by a top third-party certification provider like BSCG is so critical. GMP Compliance & BSCG

There has been a recent uptick in FDA action focusing on violations of current Good Manufacturing Practices(cGMP) stemming from product labelling,specifications, and testing requirements. In August, the FDA issued a warning letter to a company for failing to verify that the finished batch met specifications for identity, purity, strength, and composition; to establish and follow laboratory control processes to perform evaluations; and to dispose of label and packaging for dietary supplements that were obsolete or incorrect. These violations led the FDA to deem several of the company’s products as adulterated.

“Third-party certification programs can help answer important questions for downstream customers. Are THC levels below legal limits? Does the material come from legal hemp? Is the production process consistent? Do CBD levels meet label claims? Are any harmful environmental contaminants present? Could my CBD product cause a positive drug test? Are dangerous synthetic cannabinoids substituted for CBD? Brands often try to answer these questions themselves, but when a qualified third-party provider verifies the claims a higher level of trust is established.

“Third-party certification programs deliver on a growing consumer demand for transparency, which can be especially important in the CBD and hemp product arena. The FDA Tests Show Many CBD Products Do Not Contain the Amount of CBD Indicated on Label

In July, the FDA published results of tests for 147 CBD supplement products and found that of 102 products declaring CBD content, 18 contained less than 80% of the amount of CBD claimed, 46 contained CBD within 20% of the amount indicated, and 38 products contained more than 120% of the amount of CBD stated. In this New Hope article, journalist Todd Runestad writes, “It’s buyer beware when it comes to the wild west of hemp CBD products.” And he concludes: “Savvy consumers need to rely on a sophisticated third party to help them navigate the hemp CBD market.”

Meet Tim Stewart, PhD., BSCG’s GMP Manager
Tim Stewart, PhD, serves as our Compliance Review Officer supporting the BSCG Certified GMP program with onsite audits and conducting initial quality control process reviews and label and claims evaluations for new products in the BSCG Certified Drug Free, BSCG Certified CBD and BSCG Certified Quality programs.
A longtime consultant with more than 15 years of experience in the food, dietary supplement, over-the-counter drug, and cosmetic industries, he specializes in cGMP compliance by facility auditing, employee training, and developing
appropriate specifications and test methods. Dr. Tim brings a deep level of experience in cGMP compliance to the BSCG team.
Tim previously worked as the Quality Control Manager at Paragon Laboratories. He received his PhD in chemistry from USC in 2009, and has co-authored 19 scientific articles relating to chemistry and molecular oncology in peerreviewed journal publications.

China Cracks down on Doping Agents Criminalizing Use, Manufacturing, and Distribution of Performance Enhancing
Drugs

In extending its fight against doping, China in November announced a new crackdown on performance enhancing drugs that includes criminal punishments against athletes and coaches who use them. The policy extends to producers and distributors
of banned substances and products that contain them, which is of vital consideration to the nutrition industry. The new law went into effect on January 1.

BSCG strongly advises that any dietary supplement, sports nutrition, or related company engaged in raw material or finished product operations in China have their products tested by a trusted third-party certification provider to ensure protection in this new environment. NDMA Contamination in Drugs Should be Examined in Dietary Supplements

In early April, the FDA (U.S. Food & Drug Administration) announced it had requested manufacturers immediately
withdraw all prescription and over-thecounter drugs from the marketplace. Zantac and generic products containing ranitidine were recalled. In higher-than-room temperatures, these products may expose consumers to the carcinogen NDMA.
As it happened, in January, BSCG began developing a testing standard for NDMA and has been working to build a method that can soon be added to our testing of products enrolled in the BSCG Certified Drug Free program. BSCG remains the only third-party certification provider to include testing for prescription, over-the-counter,
